Wood is a natural material that responds to temperature and humidity changes by expanding and contracting. Sometime this can show in the appearance of a piece as the fibres adjust. This is not a fault with the piece, just a natural reaction of the wood. Movements and cracks could appear, although this adds to the character of a reclaimed piece. Notty Reclaimed cannot be held accountable for these movements as it is an inherent quality of wood.
We take every care to ensure our craftsmanship means you can enjoy your piece for years to come. To continue this care, we advise to keep your piece at a consistent temperature and avoid placing it close to any heat source or excessive moisture. During Winter months ensure that heating is kept low around the piece. In Summer, direct or intense sunlight should also be avoided.
We create our pieces from reclaimed wood full of character which displays its previous life. This could include nail holes, dents, notches, marks, splits, or natural variations in colour or texture etc. Each of our pieces is created from the reclaimed wood available at the time of creation.
Reclaimed wood dimensions will not necessarily be as exact as using brand new wood, therefore the dimensions on the finished piece can vary slightly.
In this document the following words shall have the following meanings:
. 1.1 "Agreement" means these Terms and Conditions together with the terms of any applicable Specification Document;
. 1.2 "Customer" means the organisation or person who purchases goods and services from the Supplier;
. 1.3 "Intellectual Property Rights" means all patents, registered and unregistered designs, copyright, trade marks, know-how and all other forms of intellectual property wherever in the world enforceable;
. 1.4 "Specification Document" means a statement of work, order form, quotation or other similar document describing the goods and services to be provided by the Supplier;
. 1.5 "Supplier" means Notty Reclaimed
. 2.1 These Terms and Conditions shall apply to all contracts for the supply of goods and services by the Supplier to the Customer.
. 2.2 Before the commencement of a commissioned piece a specification is to be agreed. Any agreed specification cannot be amended by The Customer after commencement. All request will be considered and amendments made if possible. The Customer shall notify the Supplier immediately if the Customer does not agree with the contents of the Specification Document.
. 2.3 The Supplier shall use all reasonable endeavours to complete the project within estimated time frames but changes and delays may occur. Please do not commit to events prior to receiving your pieces.
3 PRICE AND PAYMENT
. 3.1 The price for the supply of goods and services are as set out prior to the commencement of a piece. Cost may be amended by necessity by The Supplier and agreement will be sought from the The Customer before further work is carried out.
. 3.2 A small deposit shall be required prior to the commencement of any commissioned piece. All deposits are non refundable and payment of a deposit constitutes acceptance of these terms and conditions in full.
.3.3 Any pieces despatched via a courier or 3rd party will require full payment at least 24hrs prior to despatch. Any delay of this payment will push back the despatch and a 50% failed delivery fee will be chargeable. Any pieces collected will require full payment to be cleared prior to collection. We only accept payment via bank transfer.
3.4 Any settlement agreed with a customer is binding, full and final. Goods are accepted and further negotiation, including return, will not be entered into.
4 SPECIFICATION OF THE GOODS
All goods shall be required only to conform to the specification agreed prior to commencement of the project. At Notty Reclaimed we create unique custom pieces and so do not create direct copies of other makers work. As reclaimed wood and components are used some items may not be identical to others you have seen. This is due to availability of wood and components. This includes but is not limited to type, colour and condition of wood. Reclaimed wood does contain features for example small knot holes, hairlines or differences in colour and texture.
We will paint the visible areas of the piece. Areas, for example underneath of picnic tables, are not painted.
All measurements provided by the customer need to be exact when given to make additional pieces eg additional legs for an existing table. Any changes needing to be made due to inaccurate measurements provided will be chargeable. Additional products ordered may differ slightly in design or materials.
Logos provided for engraving or reproduction in any form may need to be altered or modified to allow them to be applied clearly and accurately to a piece. This may mean only the company name/text of logo is used, as very complex designs or motifs cannot be reproduced.
. 5.1 The date of delivery specified by the Supplier is an estimate only and can be extended. Time for delivery shall not be of the essence of the contract and the Supplier shall not be liable for any loss, costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the goods. Please do not book in events or make contractual or informal arrangements prior to receiving the goods/pieces.
. 5.2 All risk in the goods shall pass to the Customer upon delivery. Delivery is at additional cost unless explicitly stated.
Title in the Goods shall not pass to the Customer until the Supplier has been paid in full for the Goods.
7 CUSTOMER`S OBLIGATIONS
. 7.1 To enable the Supplier to perform its obligations under this Agreement the Customer shall:
. 7.1.1 co-operate with the Supplier;
. 7.1.2 provide the Supplier with any information reasonably required by the Supplier;
. 7.1.3 obtain all necessary permissions and consents which may be required before the commencement of the services; and
. 7.1.4 comply with such other requirements as may be set out in any agreement between the parties.
. 7.2 Without prejudice to any other rights to which the Supplier may be entitled, in the event that the Customer unlawfully terminates or cancels the goods and services agreed to, the Customer shall be required to pay to the Supplier as agreed damages and not as a penalty the full amount of any third party costs to which the Supplier has committed and in respect of cancellations after commencement of a project.
. 8.1 The Supplier warrants that as from the date of delivery for a period of 30 days the goods, where applicable, are free from any defects in design, workmanship, construction or materials. This does not cover but is not limited to any marks, colour differences, dents, gaps, splits, uneven areas or any other quality attributed to reclaimed and reused wood.
. 8.2 The Supplier warrants that the services performed under this Agreement shall be performed using reasonable skill and care, and of a quality conforming to generally accepted industry standards and practices. The goods/pieces should not be used for anything other than their express purpose.
. 8.3 Except as expressly stated in this Agreement, all warranties whether express or implied, by operation of law or otherwise, are hereby excluded in relation to the goods and services to be provided by the Supplier.
9 LIMITATION OF LIABILITY
9.1 The Supplier cannot be held liable in respect of death or personal injury due to negligence or use of any goods, whether or not arising out of negligence.
. 9.2 In no event shall the Supplier be liable to the Customer for any loss of business, loss of opportunity or loss of profits or for any other indirect or consequential loss or damage whatsoever. This shall apply even where such a loss was reasonably foreseeable or the Supplier had been made aware of the possibility of the Customer incurring such a loss.
The Supplier may terminate an Agreement forthwith by notice in writing to the other if:
10.1 The Supplier ceases to carry on its business or substantially the whole of its business.
10.2 Failure to pay the balance required within 4 week of pieces being made available to the customer (despatch or collection) will result in the deposit being retained to cover costs already incurred and the sale cancelled.
10.3 The Supplier declares the projects is untenable.

If 14 days have passed by since delivery for 'off the shelf items', unfortunately we cannot offer you a refund or exchange unless faulty.
To be eligible for a return, your item must be unused and in the same condition, no damage, use or amendments, that you received it. We will refund your purchase price (minus any postage costs) via the means used to pay for the item. Your refund will be processed in 1-3 working days after receipt. When returning your eligible item please note you will be responsible for any postage costs incurred unless the item is faulty. Your refund will be processed in 1-3 working days after receipt of the items.
Our policy for custom made/bespoke/personalised items states they are not refundable unless faulty. In this case we will do all we can to rectify the issue. Please do not make any amendments or alterations to the piece as this would limit how we can assist you.
All custom made, personalised or bespoke pieces are non refundable for any other reason as each piece is created around your individual specifications.
If items are returned without prior contact and authorisation, this will be counted as a forced return and will not be refunded. This includes rejected goods or goods that cannot be delivered as agreed.
